Carmen’s Client Testimonial

While crossing the street, in the crosswalk a bus made a left turn striking her, knocking her to the ground and stopping on her foot. She pulled her foot out from under the bus tire. She suffered multiple fractures, nerve injuries and a degloving injury. The bus company had an investigator on scene soon after the accident. The investigator noted that a bus company employee was on the bus at the time of the accident counting passengers. The investigator failed to question the bus company passenger counter after the accident. There was nothing preventing the bus operator from seeing our client in the crosswalk. Our client will have to live with pain for the rest of her life. The surgeon said that the nerve that runs through her foot should look round like a piece of spaghetti but in her case it looked flat like a piece of linguini. The defendant refused to make a reasonable offer and the case was decided by a jury. The jury verdict was substantial.

In the middle of the night Angie heard a loud knock on the door and someone urging her to get out because the building was on fire. She grabbed her daughter who was an infant and her son who was 3 years old. She woke her son who was 6 years old and told him to follow her down the stairs. When she got outside and put the younger ones down she turned around only to find that her 6 year old had not followed her. She broke free from neighbors who were trying to hold her back and ran up 3 flights of stairs to find her son frozen in fear in the entrance to her apartment. There was a fire escape window but the landlord had screwed the child guard into the window frame with tamper proof screws. She had asked the landlord, before the fire, to remove the screws from the window guard but he refused. In a valiant effort to preserve her life and her son’s life, she went into the bathroom and turned on the shower to buy a few minutes knowing the fire department was on the way. After turning on the shower the ceiling collapsed landing on her and causing significant burns to her back. The fire department found her, unconscious, draped over the tub with the ceiling on top of her.

While working on a scissor lift, which is an elevated work platform, a section of ductwork that was suspended by a strap from the ceiling struck the elevated work platform causing the scissor lift and our client to fall 30 feet to the cement floor. Her mom asked the super to please have the oven cleaned. The super refused the request. Our client, in an effort to help her mom decided to help by cleaning the oven. While cleaning the oven she leaned on the door and the entire oven tipped because the oven was installed improperly. Through our investigation we learned that the oven was shipped with an anti-tip device that the installer failed to install.
